On 21 September 2023 an appeal was made to the Secretary of State for Levelling Up, Housing and Communities Government under Section 78 of the Town and Country Planning Act 1990 (as amended) against the refusal of planning permission by Nuneaton and Bedworth Borough Council and the failure of North Warwickshire Borough Council to determine the application within the statutory timeframes prescribed by the Town and Country Planning (Development Management Procedure) (England) Order 2015 and the Town and Country Planning (Environmental Impact Assessment) Regulations 2011.
After an adjournment, the Public Inquiry into the appeal proposals is to be held in April/May 2024 at Town Hall, Coton Road, Nuneaton, CV11 5AA
Following the submission of the linked appeals, as a result of further consultation responses received from Warwickshire County Council Education Authority, changes have been made to the appeal proposals.
The changes comprise:
- An update to the description of development to include reference to land for a 1 form entry primary school and a reduction in the number of dwellings proposed from 700 to 650. The new description of development is:
Outline application for up to 650 residential dwellings and land for a 1FE primary school including a new access roundabout, with associated parking, access roads, public open space, landscaping, sustainable drainage and associated works (with access only, all other matters are reserved)
- An update to the Parameter Plan to reflect the potential location of the 1 form entry primary school and minor amendment of development parcel extents.
As the appeal is to be determined by a Planning Inspector and not Nuneaton and Bedworth Borough Council or North Warwickshire Borough Council, and it is necessary to ensure all parties have the opportunity to comment on the updated proposals, the appellant is making the updated document available for comment for at least 21 days, between the dates of 27 December 2023 and 24 January 2024. The deadline has been extended to account for the festive period and to ensure all interested parties have the opportunity to make representations ahead of the Inquiry.
